Special Town Board Meeting – Tuesday, April 19, 2016 – 5:30 pm – Conference Room

Chairman Weiss called the meeting to order at 5:35 pm. Present at roll call were Weiss, Supervisors Jones, Rasch, White, Palmer, Clerk/Treasurer Polyock, Atty. Schiltz. There were seven (7) residents present.

Chairman Weiss started at the bottom of the agenda as Steve Snudden had not arrived.

The Amendment to the Lake Law Ordinance has been presented as there has been a problem with people riding on the bow of the boat with the boat traveling very fast. This would be classified as negligent operation. Palmer/Jones motion to waive the first reading of the Ordinance. Carried. Rasch/Palmer motion to approve the Ordinance as presented. Carried.

The Bluebird drainage issue was brought to the Board in 2013. In January of 2014 a scope of work beginning at a low spot at N1554 Bluebird to under Bluebird Drive and ending at Hillside Rd. Once the work was started in 2016 they began at N1549 Bluebird and also found they needed to bore under Hillside Road to dump into the ditch. The Board agreed a change order policy needs to be in place for large projects. Under $5,000 the head of the committee would be able to do the change work order as long as it is within the budgeted amount for the project. Anything over $5,000 or unbudgeted project amounts must come to the Town Board. Voltz Trenching & Excavating has presented two bills for this project. Total of the bills equals $13,197.44. White/Jones motion to pay the Voltz bills totaling $13,197.44. Carried.

Snudden arrived and presented a new bid proposal for the tile which consists of 3,000 feet of 24”, 2,000 feet of 18”, 2,000 feet of 15” and risers and connectors totaling $70,293.65. An e-mail from Mark Steinfest, NRCS was presented confirming no permits are needed. The engineer/construction plan approved by Mark Steinfest, NRCS was also presented. Supervisor Palmer had checked and said a signed copy is as good as a stamped engineer copy.

Palmer again stated that the three inlets should be on the road and not on private property. The tile will be going through three owners, Loudenbeck, Hayden, Snudden and Hillside Farmette (Leedle). Leedle will bring the tile across Hillside Farmette and Snudden will bring it to the west side of Zenda Road. Snudden will also bring it across Hayden and Loudenbeck property. Atty. Schiltz stated we will need a hold harmless agreement. Snudden stated he has insurance to cover his work. Atty. Schiltz stated easements will be needed to repair tile in the future. Rasch/Jones motion to spend up to $80,000 on Zenda drainage project subject to easements signed by ALL affected parties. Carried without negative vote.

Rasch/Jones motion to adjourn. Carried. Meeting adjourned at 6:40 pm.
